4. Permanent Residency by Spouses of Kenya Citizens

Spouses of Kenyan citizens who have been married for at least three years are eligible for permanent residency.

Applicants must:

  1. Provide proof of marriage and family life
  2. Attend an in-person interview to verify marital information

What you need to know before you apply:

  • Processing fees are non-refundable and incomplete applications are not accepted.
  • Submit a hard copy of the application to the Immigration Headquarters in Nairobi or to the Kenya overseas mission in your country of origin.
  • Submit your application using your own FNS Portal personal account.
  • Parents can submit their child's application in their FNS Portal parent account.

What are the requirements for a spouse of a Kenyan citizen to obtain permanent residency?

  • Application letter from a Kenyan spouse.
  • A printout of the duly filled permanent residence application form (Form 23), signed and stamped by a Magistrate or a Commissioner for Oaths.
  • A completed Category D - Questionnaire for Intending Applicants, generated upon completion of the online application.
  • Duly filled Residence Status Form, generated automatically upon completion of the online application.
  • Police Clearance Certificate.
  • A joint sworn Affidavit by the spouses should be attached if marriage was not solemnized in Kenya.
  • Certified copy of the marriage certificate.
  • Copies of either passport, identity card, or birth certificate of Kenyan spouse.

Foreign Spouse Requirements

  • Copy of passport or birth certificate of the foreign spouse.
  • Copies of work permit or dependent pass of the spouse.
  • Two passport-size photographs.
  • Copy of valid foreigner certificate (Alien card).
  • Copy of the Police Clearance Certificate.

How to apply

1.       Create an account on the Foreign Nationals Services (eFNS) portal 

2.       Sign in with the account you just created.

3.       Once logged in to the eFNS portal, click the "Submit New Application" tab

4.       Under the permanent residence services category select the “Permanent Residence” tab.

5.       Once your request has been processed, an invoice will be generated which you can refer to by clicking "Dashboard" and then clicking the "Payments" tab.

6.       If you are unable to pay using one of the online methods, print your registration form by clicking "Dashboard" and then clicking the "My Applications " tab.

7.       Present your application with all requirements to the Immigration office in Nairobi for payment and processing or to the Kenya Overseas Mission in the country of origin.

8.       You will receive automatic notifications via email and in your online account about the progress of your registration.
