Labour Relations
Employment standards, workplace safety, as well as employment equity and human rights obligations.
The Labour Relations Act, 2007 in Kenya serves as the primary regulatory framework for employer-employee relationships. Notably, approximately 40 percent of the Kenyan workforce is affiliated with trade unions.
TheĀ Central Organisation of Trade Unions (COTU) functions as the national umbrella organization, overseeing about 30 unions.
Kenya has also implemented a system of industrial courts. These specialized judicial bodies hear and resolve industrial disputes, providing a formal mechanism for addressing workplace conflicts.
TheĀ Labour Institutions Act of 2007 codifies the establishment of these courts, outlining their roles and responsibilities within the broader labour relations framework.
This comprehensive approach to labour relations, combining legislative oversight, union representation, and specialized dispute resolution mechanisms, aims to create a balanced and fair environment for both employers and employees in Kenya.
