Dual citizenship in Kenya

Dual citizenship in Kenya is governed by specific regulations outlined in the Kenyan Constitution and the The Kenya Citizenship and Immigration Act, 2011. Here are the key points regarding dual citizenship for Kenyan citizens:

  • Eligibility: Kenyan citizens born in Kenya can acquire citizenship of another country while retaining their Kenyan citizenship.
  • Legal Framework: This right is subject to provisions in the Kenyan Constitution and relevant Acts.

Disclosure Requirements

Dual citizens must disclose details of their other citizenship to an immigration officer. This disclosure should be made within three months of becoming a dual citizen failure to disclose can result in a fine up to 5 million Kenyan shillings or imprisonment up to 3 years, or both.

Passport Usage

  • Dual citizens can use either their Kenyan passport or the passport of their other country for entry into or exit from Kenya.
  • Using dual citizenship for unfair advantage or criminal activities is punishable by law.

5. Passport Endorsement

  • The non-Kenyan passport can be endorsed to indicate Kenyan citizenship.
  • This endorsement exempts the holder from visa, pass, or permit requirements.
